Thank you for using Wahed Wills.wills.wahed.com is a website operated by Wahed Ltd (“Wahed Wills”, “we” or “us”). Wahed Ltd is registered in England and Wales under company number 10955000 and its registered office is at 87-89 Baker Street, London, W1U 6RJ. Our VAT number is 460 783 968. We are a limited company.
2. Agreement between you and Wahed Ltd
These general Terms of Service (“Terms”) are an agreement (“Agreement”) between you and Wahed Wills and cover your use of the information, software, products and services made available through wills.wahed.com (the “Website”). By using the Website, you agree to be bound by these Terms, as well as our Privacy Policy.
This Agreement governs any use of the Website as a guest, fee paying member or otherwise.
You are responsible for making all arrangements necessary for you to have access to the Website and for ensuring any contact details you provide us with are correct and up to date. You are also responsible for ensuring that all persons who access the Website through your internet connection are aware of these Terms and that they comply with them.
The Website is offered to you conditional upon your acceptance of these Terms and any notices contained in these Terms and the Website itself. Please read these Terms carefully before you start using the Website. By using the Website, you agree to these Terms.
You must be the legal age of majority in your country of residence in order to use the Website. In no event is use of the Website permitted by those under the age of 18. By using our site, you confirm that you accept these terms of service and that you agree to comply with them. If you do not agree to these terms, you must not use our site. We recommend that you print a copy of these terms for future reference. Our site is directed to people residing in England & Wales. We do not represent that content available on or through our site is appropriate for use or available in other locations.
3. Legal Advice
Wahed Wills provides a platform for legal information and self-help. The information and documents provided by Wahed Wills along with the content on our Website related to law (“LegalInformation”) is provided for your private use and does not constitute legal advice from qualified lawyers (“Lawyers”) and should not be relied upon as such. We cannot guarantee that LegalInformation is correct, current or up-to-date, or suitable for every situation. Except as part of anEngagement, Lawyers will not review any information you provide us with for legal accuracy or sufficiency, draw legal conclusions, provide opinions about your selection of documents, or apply the law to the specific facts of your situation.
As Wahed Wills is not a regulated law firm please note that any communications between you andWahed Wills may not be protected as privileged communications under legal professional privilege. Legal professional privilege is a principle that entitles a lawyer to refuse to disclose certain confidential, legal communications to third parties including courts, tribunals, regulatory bodies and enforcement agencies.
Your use of the Website does not create a lawyer-client relationship between you and Wahed Wills, or between you and any Wahed Wills employee or representative and you are responsible for representing yourself in any legal matter you undertake through our Website, unless you are other wise represented by a lawyer.
Any directory published on the Website is provided free of charge and is for information purposes only. Wahed Wills does not endorse or recommend any charity nor does it make any warranty as to the qualifications or competency of any charity.
3.1 Third-party consultations
As part of our services we may offer the option of obtaining bespoke legal advice via a third-party law firm (“the Lawyer”). Currently we offer this option via iWill Solicitors Ltd which is an affiliate and subsidiary of Wahed Inc (our parent company). During an initial consultation, which can be done over email or via a phone/video call (which will last up to 60 minutes), the Lawyer will obtain further information from you regarding your situation in order to provide you with a competitive quote for the legal advice or documents that you require (a “Quote”) or recommend another course of action. Any Quotes will usually be a fixed price offer (also known as an agreed fee)
Quotes and any work done pursuant to a Quote (an “Engagement”) will not be governed by theseTerms but will instead be governed by the separate terms and conditions for the Engagement provided to you by your Lawyer and accepted by you before the Lawyer commences work.
By using this Service you acknowledge that the Lawyer is an independent, third-party lawyer or law firms. The Lawyers are not Wahed Wills employees or agents, and do not represent Wahed Wills. The Lawyers are solely responsible for the legal services provided directly to you. AllEngagements with the Lawyers are governed by a separate agreement between the Lawyer and you, to which we are not a party. As such, you agree that any complaints you have about theLawyer must be raised directly with that Lawyer.
Wahed Wills is not itself a regulated law firm, however, the Lawyers may be regulated by the Solicitors’ Regulation Authority. For further information on how the Lawyers are regulated please refer to the terms and conditions provided by the Lawyer at the time of engagement.
Before engaging the Lawyer, you should carefully consider the Lawyer’s knowledge and experience and ask for a written services agreement detailing the terms and conditions of the engagement, including all fees, expenses and other obligations.
3.2 Disclaimers
You agree with us (and also for the benefit of the Lawyers) that the simple answers and Initial Consultations: do not constitute legal advice and that, except as part of an Engagement, no duty of care will be established (either in tort or in contract or otherwise) between you and the Lawyer we connect you with.
We reserve the right to reject questions you ask without providing a reason. However, our reasons for rejecting questions are typically that:
- we do not undertake that type of work;
- we do not presently have anyone available who undertakes that type of work;
- you are unable or unwilling to pay for the work required;
- we are too busy/do not have time to do the work;
- there are ethical, regulatory or other reasons to refuse (for example a suspicion of money laundering, conflict of interest, insurance issues); or
- your case is too complex or difficult or we do not have the relevant skills and experience.
4. Data Protection
Any personal information you provide to us via the Website is governed by our Privacy Policy, which is incorporated into these Terms.
5. Intellectual Property Rights
For the purposes of these Terms, “Intellectual Property Rights” means any and all intellectual property rights, whether registered or unregistered, including but not limited to any patents, trademarks, domain names, URLs, design rights, copyright, software rights, database rights, rights in and to business names, product names and logos, processes, trade secrets, confidential information and any similar rights in any jurisdiction.
Wahed Wills shall retain and be assigned all rights, title, interest and Intellectual Property Rights in relation to the legal forms, questionnaires, tools, legal documents, letters, legal guides, articles and all other content found on the Website (the “Content”).
Except as otherwise provided in these Terms, you must not:
- reproduce, modify, translate or create derivative works of any Content;
- sell, license, sublicense, rent, lease, distribute, copy, publicly display, publish, adapt or edit any Content; or
- circumvent or disable any security or technical features of the Content.

6. Refunds
We do not offer refunds of the fee paid once you have completed your purchase. On occasion we may offer you the option of an alternative product or service.
7. No Unlawful or Prohibited Use
As a condition of your use of the Website, you will not use the Website for any purpose that is unlawful or prohibited by these Terms. You will not use the Website in any manner which could damage, disable, overburden or impair the Website, or interfere with any other party’s use and enjoyment of the Website. You will neither obtain nor attempt to obtain any materials or information through any means not intentionally provided for on the Website.
The Content is protected by copyright and all other applicable Intellectual Property Rights set out above. Content is for your personal use only and not for resale. Your use of the Website does not entitle you to resell any Content from the Website. For the avoidance of doubt, your use of theWebsite constitutes your acceptance of these Terms and your promise that you will not resell or otherwise attempt to commercially benefit from the Content without our written express consent.
Our status (and those of any identified contributors) as the authors of material on the Website must always be acknowledged and you must not use the material in a derogatory manner. If you print off, copy or download any part of the Website in breach of these Terms, your right to use theWebsite will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of service.

8. Ownership and Preservation of your Materials
Wahed Wills does not own any of the materials you provide to us or post, upload, input or submit to any Wahed Wills website or its associated services (collectively, your “Submissions”).
By posting, uploading, inputting, providing or submitting your Submission, you grant Wahed Wills, its affiliated companies and necessary sublicensees permission to use your Submission in connection with the operation of their Internet businesses including, without limitation, the right to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission; and to publish your name in connection with your Submission. No compensation will be paid in relation to the use of your Submission. We are under no obligation to post or use any Submission you provide and may remove any Submission at any time in our sole discretion.
By posting, uploading, inputting, providing or submitting your Submission, you warrant and represent that you own or otherwise control all of the rights to your Submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.
Our site is made available free of charge. We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

Wahed Wills does not sponsor and is not legally associated with any third party Linked Sites. Wahed Wills is not legally authorised to use any trade name, registered trademark, logo or copyrighted material that may appear in the link.
Wahed Wills does not control, endorse or monitor the contents of any Linked Site. That includes, without limitation, any further link contained in a Linked Site, and any changes or updates to a Linked Site. Wahed Wills is not responsible for webcasting or for any other form of transmission received from any Linked Site. These Terms do not cover your interaction with Linked Sites. You should carefully review the terms and conditions and privacy policies of any third-party sites.
If you use any service provided on a Linked Site, (a) Wahed Wills will not be responsible for any act or omission of the third party, including the third party’s access to or use of your customer data and (b) Wahed Wills does not warrant or support any service provided by the third party.

The information, software, products, and services included in or available through the Website may include inaccuracies or typographical errors. Changes are periodically added to the information on the Website. Wahed Wills and/or its suppliers may make improvements and/or changes to the Website at any time. Information and opinions received via the Website should not be relied upon for personal, medical, legal or financial decisions and you should consult an appropriate professional for specific advice tailored to your situation.
Although Wahed Wills will use its reasonable efforts to keep the Website available and the information on the Website reasonably accurate, Wahed Wills and/or its suppliers make no representations about the suitability, reliability, availability, timeliness, and accuracy of the information, software, products, services and related graphics contained on the Website for any purpose. All such information, software, products, services and related graphics are provided “as is” without warranty or condition of any kind. The use or otherwise of the finalised Islamic Will by you is completely at your discretion and you should consider your personal circumstances before deciding on whether the Islamic Will is suitable for you and whether to sign the Will or not. If you have any doubts or concerns about the use of the Will, then you should seek legal advice prior to doing so.
There are a number of reasons why the Islamic Will may not be suitable for your use, including but not limited to the following:
- Some or all of your assets are held in joint names and so will pass automatically to the surviving joint owner and outside the terms of the Islamic Will;
- You have foreign assets;
- You have a larger estate and inheritance tax may result from the use of the Islamic Will; and
- A beneficiary may have a special needs.
Further, in relation to the Islamic inheritance calculators and calculations provided on the website and incorporated within the Islamic Will, whilst every effort has been made to ensure the accuracy of the information given and the accuracy of the Islamic Will produced on your behalf, Wahed Wills does not make any representations as to its accuracy. You should always check any information provided with a reliable source and ensure it is accurate in your circumstances. The calculations are also based on third-party calculators which may have inaccuracies which we are unable to change. On occasions the information we ask for may not be sufficient to properly calculate theIslamic inheritance shares. Finally, if you provide inaccurate or incomplete information to us, then the calculation may not be correct.
For all the above, reasons, you should always check the final Will produced by us for your use and should only sign the same if you have satisfied yourself that it is accurate and correct.
11. General
You agree that no joint venture, partnership, employment, or agency relationship exists between you and us as a result of this Agreement or your use of the Website.
Our performance of this Agreement is subject to existing laws and legal process. Nothing contained in this Agreement is in derogation of our right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Website or information provided to or gathered by us with respect to such use.
If any part of this Agreement is determined to be invalid or unenforceable under any applicable law, including, but not limited to, the warranty disclaimers and liability limitations set out above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of theAgreement will continue in effect.We may provide you with notices, including those regarding changes to the Terms by email, regular mail, postings on the Website, or other reasonable means now known or developed in the future.
A printed version of the Agreement, and of any notice given in electronic form, will be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish of the parties that this Agreement and all related documents have been drawn up in English.

12. Modifications
We aim to update the Website regularly and can change the content at any time. We will use our reasonable efforts to keep the Website available to you, but if necessary, we may suspend access to the Website, or close it indefinitely. We will not be liable if for any reason the Website is unavailable at any time or for any period.
We may revise these Terms from time to time, and will always post the most current version on our website. If a revision meaningfully reduces your rights, we will notify you (by, for example, posting on our blog or on this page). By continuing to use or access the Services after the revisions come into effect, you agree to be bound by the revised Terms.
13. Entire Agreement
Unless otherwise specified, this Agreement constitutes the entire Agreement between you and us with respect to the Website and it supersedes all prior communications and proposals, whether electronic, oral or written, between you and us with respect to the Website.

This policy contains the Privacy statement. This policy applies to Wahed Ltd (UK registered company number: 10955000) whose registered office is at 87-89 Baker Street, London, England,W1U 6RJ (referred to as ‘Wahed’).
2. Privacy Statement (data collection and storage)
Wahed understands that its use of your information requires your trust. Wahed is committed to the highest standards of data privacy and will only use your information for clearly described purpose sand in accordance with your data protection rights. This statement contains details of the data processing that will take place.
3. Data Controller and Data Processor
A Data Controller under GDPR is the entity that determines the purposes, conditions and means of the processing of personal data.
The Data Processor is the entity that processes data on behalf of the Data Controller.Wahed Ltd, is the Data Controller for your personal information. All other Third Parties act as Data Processors in respect of your personal information held by Wahed Ltd. Wahed Invest Ltd and Wahed Tech FZE are the Data Processors responsible for its website and app.
We have appointed a data protection officer (DPO) who is responsible for overseeing questions in relation to this privacy policy. If you have any questions about this privacy policy, including any requests to exercise your legal rights (See ‘Rights to Erasure’ section), please contact us using the information set out in the contact details section (‘Contact us’ section).

In order to create an account with Wahed, we need to collect some personal details, as well as other information.

We also collect, use and share aggregated data such as statistical or demographic data which is not personal data as it does not directly (or indirectly) reveal your identity. For example, we may aggregate individuals' Usage Data to calculate the percentage of users accessing a specific website feature in order to analyse general trends in how users are interacting with our website to help improve the website and our service offering.
3.4 Why we need to collect this information
Wahed is required under General Data Protection Regulation 2016/679 to explain the lawful basis of processing of your information.
We collect this information primarily to satisfy legal requirements and to enable us to provide the services required under your contract with us.
GDPR Article 6 (1) Lawfulness of processing requires:
Processing shall be lawful only if and to the extent that at least one of the following applies:
- the data subject has given consent to the processing of his or her personal data for one or more specific purposes;
- processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;
- processing is necessary for compliance with a legal obligation to which the controller is subject;
- processing is necessary in order to protect the vital interests of the data subject or of another natural person;
- processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;
- processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.
3.5 The types of lawful basis we rely upon are:
Legal, for example verifying your identity or complying with regulatory obligations, such as MiFIDII.
Contract and legitimate interest, for example your email address and telephone number to contact you.
Consent, for example implicit consent would be the collection of your payment information for an optional service and explicit consent is for marketing or health information (special category data).
Vital interest, for example if the account holder passes away, we’re required to liaise and allow access to the next of kin.
Where explicit consent is required we will seek this from you, for example Marketing preferences and Pension. However, in the vast majority of cases explicit consent is not required, and implicit consent is inferred to perform our responsibilities under the contract.
In order for Wahed to provide you with an Islamic Will we are required to gather information about you, your family and your assets and liabilities, as well as those whom you wish to include within your Will (such as Guardians and Executors and Trustees).Where explicit consent is required and not provided it may result in non-benefit of service, or the inability to open an account with Wahed.
3.6 What we do with the information we gather
We require this information to understand your needs and provide you with a better service, and in particular for the following reason
- Performance of the contract
- Verify your identity
- To ensure the product and service is suitable
- Internal record keeping and record retention for legal requirements
- We may use the information to improve our products and services, by internal analysis of company data.
- We will only use your information for the purpose it was collected.
- Where explicit consent is given we will also use this information for marketing purposes
- Correspondence regarding your account via email, telephone
- Notify you of any changes to our service
- Tracking of your activity on our website
- Responding to your questions and ensuring your Will is appropriate for your circumstances.
3.7 Who We Share Your Information with
Personal data is processed by Wahed and may also be shared with its parent company, subsidiaries and affiliates, including, Wahed Tech FZE based in the UAE, iWill Solicitors Ltd, iWaqf Ltd, Maydan Capital Ltd as "WahedX", "Wahed Ventures" based in the UK and Wahed Inc based in the USA.
For the purposes of the contract we are required to share your information with third parties, the situations in which we share this information are detailed below.
- Regulatory bodies or the police to comply with our legal obligations.
- Fraud prevention agencies, and other organisations in order to detect and prevent financial and other crime.
- Data, service and software providers to help improve and maintain our website
- Suppliers, business partners and affiliates where necessary for the performance of the contract, including sub-contractors.
- Third parties to whom we may choose to sell, transfer or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy.
If data is processed in countries outside the EU, Wahed uses EU standard agreements, including suitable technical and organisational measures, to ensure that your personal data is processed in accordance with the European level of data privacy. International Data Transfers
Your personal data will only be stored or transferred within the UK, EU or US using standard contractual clauses, or other safeguards that have been approved by the relevant regulatory body.
We share your personal data within the Wahed Group. This may involve transferring your data outside the UK to our overseas offices in the EU, USA and UAE.
Whenever we transfer your personal data out of the UK to countries which have laws that do not provide the same level of data protection as the UK law, we always ensure that a similar degree of protection is afforded to it by ensuring that the following safeguards are implemented. We ensure your personal data is protected by requiring all our group companies to follow the same set of rules when processing your personal data. These rules are called "binding corporate rules" (BCR).
4. Your rights Subject Access Requests
You’re entitled under the GDPR Article 15 ‘right of access’ to request the personal data thatWahed holds on you. You can request a copy of this information by emailing uksupport@wahed.com.
If you believe that any information we are holding on you is incorrect or incomplete, please write toor email us as soon as possible, at the above address. We will promptly correct any information found to be incorrect.
5. The Right to Erasure
You’re entitled under the GDPR Article 17 ‘right to erasure’ to request the deletion of personal data that Wahed and our third parties hold on you. You can request this by emailing uksupport@wahed.com.
Please note, this does not affect any information required to be stored under record retention laws, more information on the retention period is set out below.
6. Retention Period
We will retain your personal data only for as long as necessary to fulfil the purposes outlined in this Policy or as required by law. Once Wahed has obtained your personal data, it will be maintained securely in Wahed’s system for the period necessary to fulfil the purposes for which the data was collected (see above). Once a Registered User, you may terminate your membership of the App by contacting Wahed (uksupport@wahed.com).
Wahed may retain your personal data even after you have closed your account if retention is reasonably necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes between users, prevent fraud and abuse, or enforce this Privacy Policy and other relevant terms. Once your personal data is no longer required, we will securely delete or anonymise it.
7. How to change your privacy preferences
You can change your preferences, or withdraw your consent in relation to how Wahed uses your personal information. You are also able to request information about your data stored at Wahed as well as request the correction, deletion or restriction of your personal data for analytics and/or marketing use.

Under certain conditions you have the right to require us to:
- Provide you with further detail on the use we make of your information
- Provide you with a copy of your information
- Update any inaccuracies in the information we hold about you
- Delete any information about you that we no longer have a lawful ground to use
- Remove you from any direct marketing lists when you object or withdraw your consent
- Provide you with your personal information in a usable electronic format and transmit it to a third party (right to data portability)
- Restrict our use of your personal information
- Cease carrying out certain processing activities based on the legitimate interests ground unless our reasons for undertaking that processing outweigh any prejudice to your data protection rights.
Your exercise of these rights is subject to certain exemptions to safeguard the public interest e.g. the prevention or detection of crime (GDPR Article 6 (1) (e)).
If you are dissatisfied with our use of your information or our response to any exercise of these rights you have the right to complain to your data protection authority, this in the UK is the Information Commissioner's Office https://ico.org.uk We would, however, appreciate the chance to deal with your concerns before you approach the ICO so please contact us in the first instance.
8. Security
We are committed to ensuring that your information is safe and secure. In order to prevent unauthorised access or disclosure, we utilise physical, electronic and managerial procedures to safeguard and secure the information we collect.
There is also a lot that you can do to help us keep your account safe. We recommend that you take the following actions:
Do not disclose your login and password details with anyone and don't store them on your device(s). If you feel someone may know your login details or if you lose your device then contact us immediately to prevent unauthorised access to your account.
Access your account using the best security offered by your browser to maintain the security of your account, this for example would be incognito for Google Chrome and Private browser for Safari.
